Booking Terms
for UK Guests
The booking form must be completed and signed by
the party leader (the client) who must be over 18
years of age. The signing of the booking form shall
be deemed to be a contract with the client and Roy
Lodge and will constitute the acceptance of the
booking and payment procedure terms and conditions
by the client and shall be a warranty by the person
so signing that they have the authority to act on
behalf of the persons named on the booking form
including any substitutions or additions by any
subsequent agreed amendments to the booking. The
procedures and conditions will still apply even
if for any reason the booking form has not been
completed by the client, e.g. In the case of a late
booking requested by telephone which necessitates
immediate commitment. The booking is not accepted
until the completed and signed booking form together
with the appropriate deposit has been received and
the acknowledgement receipt has been issued. If
the booking is not accepted for any reason the deposit
will be refunded in full. Amendments to, or cancellation
of a booking by the client will be subject to the
provision of the Cancellation sections of these
terms and conditions. The accommodation cannot be
shared assigned or sublet and the only persons shown
on the booking form are permitted to stay in the
property. Persons, children under the age of 18
years are not acceptable unless accompanied by a
parent or parents or an adult. Pets and Smoking
are not allowed. Any infringements of these conditions
may result in the bond being withheld.
Booking Terms
for World-wide Guests
The e-mail correspondence or any telephone arrangements
will form the contract between Roy Lodge and the
Party leader. The Party Leader will be the person
that has communicated by e-mail and has discussed
the contract with Roy Lodge by telephone. It is
this persons Postal address and e-mail address that
will be used for any further communication. The
booking is not accepted until the appropriate deposit
has been received into Roy Lodge's bank account,
the check has cleared and the acknowledgement receipt
has been issued. If the booking is not accepted
for any reason the deposit will be refunded in full.
Amendments to, or cancellation of a booking by the
client will be subject to the provision of the Cancellation
sections of these terms and conditions. The accommodation

Payment
Deposits and payments are to be made in accordance
with the booking and payments procedure provided
by Roy Lodge at the appropriate stages. Failure
to comply with these arrangements will be deemed
to be a cancellation by the client and will be subject
to the cancellation charges as detailed below..
The Rental Period.
Reservations normally run from Saturday to Saturday
and are for a minimum of 7 nights( other than by
arrangement)
The Villa is available for occupation from 4.00
p.m. (local time) on the day of arrival until 10.00
a.m. on the day of departure. Vacating after 10.00
a.m. May incur charges equivalent to one days occupation
cost.
Rental Charges
The villa rental charges and the items included
are as agreed by the client and Roy Lodge at the
booking procedure stage.
Price Guarantee
The rental price for the villa is fully guaranteed
when the deposit has been paid and the acknowledgement
receipt has been issued.
Amendments
The effective date of any amendment is the date
on which details of the proposal amendment are received
in writing.. Whenever possible any amendment to
the booking requested after the booking has been
confirmed, will be accommodated dependant on the
nature of the amendment additional costs may be
incurred.
The Security
Bond
The client is solely responsible for any damages
or breakage's that may be caused to the property
by the client or the client’s guests or to
its contents, furniture and fittings and also for
any loss of items in the inventory during their
stay or indeed any breaches of the rental agreement.Therefore
a £150 ($250) refundable security bond payable
with the final balance, will be held against such
an eventuality. The villa is inspected both before
and at the end of each occupation and upon confirmation
that all is in order, this deposit will be refunded
in full. Since it is not possible to check the accommodation
before departure, the security bond will be reimbursed
2 weeks after departure . Charges for damages ,
losses or any maintenance or repairs to equipment,
amenities, fixtures necessitated by misuse will
be at the discretion of Roy Lodge and will be deducted
from the security bond. In the event of any damage
or loss which is assessed to be in excess of the
security bond, the client will be held responsible
for full reimbursement of the outstanding amount
within fourteen days. If this amount of money is
not received within 14 days, these terms and conditions
will constitute the notice required before action
when applying to the appropriate County Court.
It would be appreciated if the property is left
in a clean and tidy condition at the end of the
rental period. If the villa is left in a unreasonable
state of cleanliness then penalties will also apply.
Cancellation
by the Client
Any cancellation by the client must be notified
in writing or e-mail directly to Roy Lodge. Cancellation
by telephone will not be accepted. In the event
of cancellation by the client, the following charges
will apply.
PERIOD BEFORE DEPARTURE CANCELLATION CHARGE
More than 10 weeks........ Deposit only.
Less than 10 weeks ..........100% of all costs (i.e.
No reimbursement)
Cancellation
by Roy Lodge
In the unlikely event that circumstances beyond
our control necessitate cancellation of the booking
. We will refund any moneys paid by the party leader
(without interest), compensation or sub sequential
loss of any kind.)
International
Travel Requirements.
Clients are personally responsible for the provision
of international and health documentation. Cancellation
caused by clients due to incorrect documentation
will be charged the relevant cancellation fees.
Force Majeure
Roy Lodge and his representatives accept no responsibility
whatsoever and no compensation or any other payment
will be made if any cancellation or change to the
terms of the booking becomes necessary due to war
or threat of war, riots, civil commotion, terrorist
activities, industrial disputes, natural disasters,
fire, flood, adverse weather conditions, technical
problems with transportation, closure or congestion
of airports, alterations or cancellation of schedules
by carriers, or any other events beyond Roy Lodges
control.
Complaints.
Should a problem arise whilst on holiday relating
to the premises, immediate contact should be made
with our representatives who will seek to resolve
matters speedily.
Brochure Description
Whilst all information supplied in the brochure
is deemed to be correct and to the best of our knowledge,
it is understood that the information supplied is
for guidance purposes only and does not form part
of any contract.
Free Unlimited telephone calls
Any calls to a cellphone in the UK or USA will incur
a charge of £3 ( $5 US) per minute.
We have an arrangement with our telephone service
utility to monitor all cellphone calls on the date
they were called. All charges incurred by cellphone
calls will be deducted from the security bond.
Normal phone calls are free as advertised. We apologise
for this inconvenience but the charges are out of
our control.
Burglar Alarm
If the Police/Sheriff are called out due to an inadvertent
operation of the burglar alarm then a charge will
be imposed by the local Sheriffs department on the
villa owner. This charge will be deducted from the
security bond.
Use of PC and
Internet
Computers, unfortunately are susceptible to malfunction
periodically. Therefore the risk of this happening
must be accepted by the client when the villa is
booked. If the PC fails during your vacation we
will endeavour to fix the problem as soon as possible.
The same condition also refers to any failures due
to the Internet Service Provider.
Guests sometimes feel the need to alter the computers
settings. If the settings to the PC have been changed
to a degree such that the PC requires maintenance
time to correct the problems then a maintenance
fee will be deducted from the bond. This also applies
to any unauthorised material found on the PC hard
drive after the guests have departed.
WC/Toilet
Toilet blockage can occur from time to time due
to guests disposing of sanitary towels or the use
of excessive toilet tissue usually by children.
If this happens the toilet can be unblocked with
use of the rubber plunger supplied.
If the management company is called out to unblock
the toilet. They will charge the guest $40.
Limitation of
Liability
Although every effort is made to ensure that the
villa is in perfect condition, Roy Lodge cannot
accept responsibility for third party claims, accidents,
damage, or loss of property, or for any expenses
incurred for any reason, including changes caused
by Force Majeure, regardless of howsoever they have
occurred, nor can liability be accepted for injury
as a result of the use of the swimming pool, howsoever
caused. Guests are specifically advised not to allow
unsupervised children to use the pool. Glass is
not permitted in the pool area. There is a fold
up security fence erected between the villa and
swimming pool which restricts access to the pool.
It is strongly advisable that when young guests
or non swimmers are present that this fence should
remain in position at all times. If the fence is
rolled back by the client then full responsibility
for that action shall be the clients.
BBQ Grill
The grill is a gas only grill and using coals or
other types of solid fuel will seriously damage
the grill. If this happens then the guest will be
responsible for the damage that the solid fuel has
caused. Gas for the grill is to be borne by the
guest and new gas bottles that may be required during
the guest stay will be the responsibility of the
guest. When the gas BBQ grill is used during the
stay then the guest is responsible for keeping the
grill in a fit state of cleanliness in readiness
for the next guests. If the BBQ gas grill is found
to be needing a satisfactory clean after the guest
has vacated the villa then the cost of cleaning
will deducted from the security bond. The present
cost of a clean stands at $30
Pool temperatures
Pool temperatures are dependant on local weather
conditions. Florida ambient temperatures during
winter nights can drop below 50 degrees F. The Pool
water is heated by a "Heat Pump" this
device takes heat from the outside air and uses
it to heat the pool. This may result in early morning
pool temperatures falling below 82 degrees F until
the sun heats up the morning ambient air. If this
happens pool temperatures will recover to normal
by lunch time.
Law
This contract is subject to and shall be construed
in accordance with the Laws of the United Kingdom
and the parties hereby submit to the exclusive jurisdiction
of the United Kingdom Courts.
